Terms and Conditions of Surprisadate LLC

Welcome to Surprisadate LLC.
These Terms and Conditions ("Terms") govern your use of our services, website, and the purchase of any packages or add-ons from Surprisadate LLC ("we," "us," or "our"). By accessing our website or purchasing a service, you agree to these Terms. Please read them carefully.
1. General Information
Surprisadate LLC is a Florida-registered company with branches across the United States. Our first branch is based in Pinellas County, Florida, and other branches will operate within their specified geographic areas, which will be detailed on each branch’s webpage. These Terms apply to all locations unless specified otherwise.
2. How You Hear About Us
Customers may discover Surprisadate through word of mouth, advertising (TV, radio, social media, flyers, or business cards), promotional events, festivals, or through third-party contacts such as hotel concierges or restaurant staff. By purchasing our services, you acknowledge that your interaction with our company is initiated via these means.
3. Ordering and Payment
Orders are placed through our website and paid via credit card or other accepted electronic payment methods.
You agree to provide accurate and complete information when placing an order.
Payment confirms your acceptance of these Terms.
4. Package Options & Customizations
Packages:** Customers choose between:
Music Performance Package: Live musician performing a song from our pre-approved list.
Portable Speaker Package: Pre-selected song played via portable speaker or any appropriate song chosen by the customer.
Song Selection:** For live musicians, only songs from our pre-approved list. For portable speakers, customers may select any appropriate song.
Voice Message:** Customers may pre-record an appropriate message to be played alongside the music.
Add-Ons:** Options include a Video/Photo package and a Luxurious Path of Rose Petals, subject to location and feasibility.
Telegram: Customers must download the app, Telegram to use some Portable Speaker Services and Video/Photo Package.
5. Delivery & Location
Deliveries are scheduled within a specific geographic radius, detailed on each branch’s webpage.
Customers are responsible for providing accurate delivery location details and ensuring accessibility.
Delivery times are generally scheduled at 1.5-hour intervals. Customers must communicate with the driver to ensure timely start.
Surprisadate is not responsible for late arrivals due to customer delay or unforeseen circumstances.
6. Song & Performance Responsibility
The customer assumes full responsibility for the choice of song, including appropriateness and reactions.
If a live musician does not arrive, we will play the song via our portable speaker and refund the musician fee, plus a 20% discount on next future booking.
Surprisadate makes no guarantees regarding the quality or performance of musicians or the outcome of the delivery.
7. Recording & Photography
Video and photo recording are optional add-ons.
Recordings will be sent via Telegram, and the customer must have or create a Telegram account.
Surprisadate deletes all recordings post-transfer to protect privacy, unless customer agrees for Surprisadate LLC to use these materials for promotional purposes.
The customer assumes full responsibility for any privacy concerns or objections from the recipient or third parties.
8. Contents of Gift Basket
Each delivery includes a gift basket with a plush teddy bear or other plush toy, assorted candies, and a personal message.
The contents, including colors of lighting and decorations, are subject to availability and location constraints.
Surprisadate is not responsible for allergies or reactions to all contents, flowers or candies.
9. Additional Options & Variations
Rose Petal Path:** We will sprinkle real rose petals leading to the surprise, but presentation may vary by location.
Weather Conditions:** Surprisadate is not liable for delays, damages, video/photo quality, Live Musician performance or portable speaker audio quality caused by weather. Extreme weather may warrant rescheduling or full refunds.
10. Cancellations & Refunds
Cancellations must be made at least 12 hours prior to the scheduled delivery to qualify for a refund.
Cancellations within 12 hours of the scheduled delivery are non-refundable.
Refunds will be processed via the original payment method.
11. Liability & Indemnity
Surprisadate is not responsible for allergic reactions, dissatisfaction with performance, or offense caused by song choices or delivery content.
The customer agrees to hold Surprisadate harmless from any claims, damages, or liabilities resulting from:
The outcome of the surprise.
Allergic reactions.
Privacy violations.
Delays or damages caused by weather, transportation, or third-party interference.
The customer assumes full responsibility for the outcome and whether the recipient or the public reacts positively or negatively.
12. Weather & Force Majeure
Delivery is subject to weather conditions. Severe weather may lead to rescheduling or cancellation.
Surprisadate is not liable for delays, damages, or cancellations due to acts of nature, accidents, or other force majeure events.
13. Changes to Terms
Surprisadate reserves the right to update or modify these Terms at any time without prior notice. Continued use of our services constitutes acceptance of any changes.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed under the laws of the State of Florida.
Any disputes arising from these Terms shall be resolved in the appropriate courts of Pinellas County, Florida.
By completing your purchase, you agree to these Terms and Conditions and acknowledge that you have read and understood them.
